Reservation conditions 

Rental and payment conditions for the rental property Seehütte Rust, Romantika I/13, 7071 Rust by the landlord community Wolfgang and Laila Suppan, Kapellengasse 14, 2361 Laxenburg.

These reservation conditions relate to the rental of the Seehütte and regulate the legal relationship between the landlord and the tenant of the hut. The rental services of the hut presented below are offered exclusively under the present reservation conditions. By completing a booking, the tenant confirms that he has read and understood the reservation conditions and agrees to them. However, the landlord reserves the right to change the reservation conditions and to adapt them to the legal provisions.

Conclusion of the agreement/booking:
1. After the tenant has made a booking request (via the Internet or by telephone), he will receive a booking confirmation (by email) from the landlord.

2. Upon receipt of the booking confirmation, the tenant pays the rental price including the required deposit within a period of 24 hours. Possible payment methods are: transfer to the landlord's bank account and transmission of the transfer confirmation by e-mail or payment by PayPal payment depending on the agreement. If the payment is not received within this agreed period, the landlord has the right to rent the rental property to another tenant without further consultation.

3. The tenant must send a photo of all the guests' passports by email with the booking, as these are necessary for the guest sheet. Reference is made to the data protection declaration below.

rental rates
Rental prices, season times and rental periods are described online and are binding; the price quoted refers to one rental period. The tenant is fully liable for damage in/to the house, terrace or boat that occurs during the rental period and for which the tenant is responsible, even if no deposit has been requested. The same applies to missing inventory (compared to the inventory list). The inventory list is available in the Seehütte and is considered binding and fully accepted unless objected to within the first day.

Deposit
A deposit is required upon booking. The deposit is used for payment or down payment for damage to the house, boat, inventory or excessive dirt or increased cleaning effort (e.g. because pets are not allowed). For damage in/on the house, terrace or boat that occurs during the rental period, the tenant is fully liable with his deposit and in the case of major damage beyond that. Damage that occurs for which the tenant is responsible or missing furnishings or other inventory will be charged to the tenant and deducted from the deposit. An inventory list is available in the hut and is considered to be in order if this is not contradicted on the day of arrival. The payment of the deposit is due at the same time as the payment of the rent.

Services

 The rental price includes the following services of the landlord:
1. Provision of the rental property for use during the rental period.
2. Provision of bed linen, hand and bath towels, tea towels during the rental period for use in the rooms of the holiday home.
3.  Proportional energy costs (water, electricity, heating, air conditioning, etc.) for the duration of the rental by the tenant.

occupancy of the holiday home
The holiday home is rented for a maximum occupancy of 4 people. The minimum age for children is 10 years. Pets are strictly forbidden. Two double beds under the roof can only be reached with a ladder and are therefore not suitable for people with restricted mobility. Access to the holiday home is via a bridge with about 10 steps. In the event of unauthorized overcrowding, the landlord can terminate the agreement without notice or compensation and withhold the rent paid. Please note that guests are not allowed to stay overnight in the holiday home without an agreement with the landlord.

duty of supervision

The tenant is informed that the kitchen, living room, 1 bedroom and bathroom with toilet are on the ground floor in the holiday home. The shower is outside. 2 more beds (double bed without feet and headboard) are located under the roof with access only by ladder. In particular, he must inform children, people with disabilities and accompanying persons of the corresponding dangers. The landlord generally excludes any liability.

House rule
The tenant keeps the rented property in a tidy condition and pays particular attention to the fact that the garbage is regularly disposed of in the garbage cans provided for this purpose (the location description of the garbage place is in the house rules, which are sent before the start of the rental period). The tenant leaves the rental property tidy and cleaned of garbage and used dishes.  Smoking is not permitted inside the holiday home, you can smoke on the terrace using ashtrays. Butts and ashes may not be thrown on the property or in the lake. Bringing dogs or pets is generally prohibited. If the tenant violates the ban on pets and the landlord only becomes aware of this after moving out, a flat rate of € 300 must be paid for the increased cleaning effort, exchange of bed linen, etc. The local quiet times are to be observed by the tenant and his companions as well as his guests. From 10:00 p.m. to 7:00 a.m. night rest applies. Any disturbance of the peace such as parties, celebrations or noise are expressly prohibited.  In the event of cancellation of the reservation/rental agreement, the landlord's claim to the agreed rental price remains. This also applies to early departure. The reasons for non-appearance are irrelevant. Accordingly, the landlord refers to a travel cancellation insurance. Take out travel cancellation insurance with an insurance company of the renter’s choice. The tenant must be able to prove household insurance and confirms this by accepting the booking. This also applies to early departure. If the tenant withdraws, the landlord has a flat-rate claim for fees (as a percentage of the total rental price). 

Defects and damage to the rental property
The tenant undertakes to report all defects, all damage or problems with the energy supply to the landlord (indicated in the booking confirmation) immediately by telephone. The same applies to the loss or late return of the key. In this case, the landlord is entitled to have a new locking system installed at the expense of the tenant without further consultation with the tenant. The tenant is liable for damage to the rental property or lost furnishings/inventory caused by him or third parties under his responsibility (e.g. accompanying persons, guests and visitors).

Liability for damage suffered by the tenant and third parties

The lessee, his companions and visitors and the items they take with them are not insured by the lessor during the rental period, even if the cause arose in connection with the rental property. The landlord assumes no liability whatsoever for any damage. The tenant is liable.

arrival and departure
The key for the holiday home is handed over to the tenant at the beginning of the rental period using a key box and code. During the holiday stay, the tenant is responsible for the secure storage of the key. The guest undertakes to return the key to the key box when moving out of the holiday home. The rented property is taken over by the tenant directly on site at the agreed start of the rental period. The rental property can be taken over on the day the rental begins between 3:00 p.m. and 8:00 p.m. There is an inventory list in the holiday home. This is deemed to have been fully and correctly accepted if the lessor does not receive any feedback to the contrary within the first day of arrival. The rental property and, if applicable, the key must be returned on the agreed departure day between 10:00 a.m. and 11:00 a.m.  . After consultation and corresponding agreement between tenant and/or landlord, an early return can be agreed.

Services not used by the tenant

If the lessee does not make use of the services for reasons for which the lessor is not responsible or because of force majeure or if he complains about them, the lessee is not entitled to a refund of the rental price, not even pro rata.

Travel warnings for Austria: Interested parties are asked to carefully monitor the travel warnings of their countries. If there is a travel warning for Austria or for Lake Neusiedl in your home country and the Seehütte is booked despite being aware of this travel warning, the agreed price for the overnight stays must be paid by the booker even if the customer does not use the service because the travel warning is in place takes/can take.

Premature termination of the rental agreement

The landlord is entitled to demand the agreed fee if the tenant does not appear. During the tenant's stay, the landlord can terminate the rental agreement without reimbursement if the tenant, his companion or visitor makes significant subsequent use of the rental object or the provisions of the contract (house peace, municipal and statutory regulations, use contrary to contract) despite ( also verbal) warning. If the rental contract is terminated for an important reason, the tenant is obliged to pay the fee. The landlord will deduct what he saved by not using the rental or what he received from other rentals.

Lessor Disclaimer
The landlord assumes no liability, especially in the event of disruptions in performance or the impossibility of performance. Should any part of this agreement be or become invalid, this shall not affect the validity of the other parts. The ineffective parts are replaced by agreements that are most similar to the meaning of the ineffective part. The landlord cannot foresee whether official measures will make an overnight stay impossible. In any case, we will inform you on our homepage as soon as we become aware of such regulations or defects. If the booked service cannot be carried out due to official measures, the customer does not have to pay any fee. This applies from the point at which the landlord was informed of the official measures and stated this on his homepage.

Essentials for using the electric boat

The electric boat is part of the equipment of the rental property and the tenant must therefore treat it with the same care as the rest of the rental property. During the boat trip, the renter bears full responsibility for the boat and crew in accordance with lakes and river traffic regulations BGBI No. 42/1990. This is available for inspection in the Seehütte. The minimum age for using the electric boat is 18 years. The use of the boat is at your own risk, standing and swinging in the boats is prohibited. Parents / other supervisors have to fulfill their duty of supervision and are responsible for the safety of their children (wearing life jackets, behavior in the boat...). The lessee is also responsible and liable for contamination of water, shore and the environment by the lessee. Rubbish and rubbish must be taken ashore and disposed of in the containers provided. The reed belt, water lily areas, signposted protected zones and cordoned off swimming or sports areas may not be driven on. The instructions of the landlord or the persons working for him must be followed. The renter is fully liable for damage to the boat or its accessories (e.g. due to improper use). The lessor assumes no liability for damage to third parties when the lessee uses the boat. In the event of damage or accidents, the landlord must be notified immediately by telephone, instructions for further behavior must be awaited. Damage that is not reported will be considered intentional and will be charged (even retrospectively). If damage is not reported, the renter can also be held liable for consequential damage (e.g. failure of the boats due to repairs). The renter undertakes to return boats and accessories clean, otherwise a cleaning fee may be charged.  

Right of withdrawal

  1. Cancellation within 48 hours of booking: full refund if check-in date is at least 14 days in the future, after that 50% cancellation fee will apply.

  2. 30 days before check-in date to 14 days before check-in date 70% cancellation fee applies.

  3. 14 days before check-in to 7 days before check-in 80% of the rental price. No refunds for cancellations made within 7 days of check-in.

Place of performance, place of jurisdiction and choice of law

Place of performance is Seehütte Romantika I/13, 7071 Rust. The rental contract is subject to Austrian law. The use or copying of this text, even in part, is prohibited by copyright.

Miscellaneous

All changes to the rental contract must be in writing.
